Digital Coaching Sessions – Terms & Conditions

Before you start your coaching journey with me, please have a read through my session terms & conditions to ensure that you are clear with what I am able to provide for you.

Proceeding through booking & payment along with ticking “I have read & agreed to the Digital Coaching Sessions terms & conditions” will confirm that you are happy & satisfied with all aspects of the terms & conditions detailed below.

All coaching services & communication, email or otherwise, will be delivered by me, Kelly or from time to time, you will be updated by email by my team. The information I provide on this website -www.thegreenthread.com & via my coaching sessions is designed to help you to identify which areas of your online business are best for you to focus your energy so that you can work to achieve the results that you so wish. My coaching is here to guide you & suggest solutions based on your individual circumstances.

The term ‘coaching’ as used in these terms & conditions covers online business coaching including social media, websites & digital organisation & overwhelm tips.

The person ‘Coach’ when used in these terms & conditions refers to Kelly.

I strive to meet my strong desire to help others & with my coaching sessions will do everything that I can to do just that. I will send you a form to fill out prior to each session, this has been designed by me to help you get the very most out of your session & will give you the opportunity to highlight any key points that you would like to discuss. After our session, I will summarise what we have discussed via email, providing you with a PDF document containing action points as well as tips & pointers. From here I will make suggestions for any additional coaching I believe is required, this is to be taken as, when & if you so desire & will be bookable via the same method in which previous sessions have been booked.

Feedback is important to me. I wish to know how you have found your coaching experience with me & very much welcome any comments & suggestions on areas of improvement. In addition to your follow-up form, I will send a feedback form following each session.

DIGITAL COACHING DISLCLAIMER

I understand that the coaching service I will be receiving from my Coach does not in any way constitute solid advice but rather, is here to give me ideas of what I could put into action. Any decisions made for my business are & remain my sole responsibility.

For legal purposes, I understand that coaching is currently an unregulated industry & that my Coach is not “licensed “ by any UK or other country’s regulating body.

I understand that all comments & ideas offered by my Coach are solely for the purpose of aiding me in achieving my business goals. I have the ability to give my informed consent, & hereby give such consent to my coach to assist me in achieving such goals & understand that results are not guaranteed.

I understand that to the extent our work together involves career or business, my Coach is not promising outcomes included but not limited to increased clientele, profitability & or business success.

I understand that my Coach will protect my information as confidential unless I state otherwise in writing. If I report neglect or any unlawful activity, I understand that necessary actions will be taken & my confidentiality agreement will be limited in this capacity. Furthermore, if my Coach is ordered by a court to provide information or to testify, she will do so to the extent the law requires.

I understand & accept the risks of confidentiality in the use of email, text, phone, Zoom, Skype & other technology.

I hereby release, waive, acquit & forever discharge my Coach, any agents, successors, assigns, personal representatives, executors, heirs & employees from every claim, suit action, demand or right to compensation for damages I may claim to have or that I may have arising out of acts or omissions by myself or by my Coach as a result of the advice given by my Coach or otherwise resulting from the coaching relationship contemplated by this agreement.

I further declare & represent that no promise, inducement or agreement not expressed in this agreement has been made to me to sign this agreement. This agreement shall bind my heirs, executors, personal representatives, successors, assigns, & agents.

TERMS & CONDITIONS

My coaching session duration & type will be determined by me, when booking via the bookly booking system at www.thegreenthread.club or via the Facebook or Instagram booking systems. It is at this point that I take responsibility to ensure that I select a duration time & session type that I believe, is suitable for my needs. I understand that I can email Kelly at kelly@thegreenthread.club at any time with any queries or questions regarding a coaching session including further information on their type & duration.

I understand that Kelly will plan & structure our session to cover as many of the key points, as outlined, by me via my pre-session preparation form, as she possibly can do. I also understand that whilst Kelly will endeavor to meet my needs within the allocated time frame, should she believe that the key points far exceed the allocation time frame she will contact me in advance with a proposed alternative.

In return for the fees payable by the client (or by a third party on their behalf), Kelly agrees to provide the service as described & in accordance with the terms & conditions set out. The client agrees to pay fees for the service on the terms & conditions set out (in situations where a third party pays the fees, the third party counts as an agent acting on behalf of the client).

The date & time that the coaching session takes place shall be determined via the bookly booking form system at www.thegreenthread.club, via the Facebook or Instagram booking systems, or in some instances, as agreed via email. Where any client is unhappy with any aspect of the terms & conditions they can contact Kelly to discuss any concerns & see if they can be resolved before the first coaching session. Participation by any individual in the first coaching session constitutes acceptance of these terms & conditions.

FORMAT OF SESSIONS

Via Zoom (video communication software) or other formats where such is agreed. Both Kelly & the client are responsible for ensuring that they are available for consultation at agreed times. Failure to remain committed to agreed times will result in a full refund for the client Kelly fails to be available or full forfeit of the session fees should the client not be available.

SESSION FEES

In accordance with Kelly’s current published prices per session fee. All sessions are payable in advance using either the PayPal or Square Space payments system at www.thegreenthread.club or in certain circumstances, by bank transfer to The Green Club Ltd.

PAYMENTS MADE

For all coaching sessions, payment is required in advance. Depending on your preference, you have the option to quickly & securely pay through SquareSpace or Paypal, both of these services will take you through to their third-party payment gateway. ADDITIONAL SESSIONS

Kelly may agree to provide additional coaching sessions after completion of the initial agreed session(s). These terms & conditions will apply to any additional sessions so provided & the Per Session Fee will remain the same as originally agreed except where Kelly notifies the client in writing by letter or e-mail of a change to the Fee or to any other term or condition in accordance with the section in these terms & conditions headed “Variation of Terms and Conditions”.

DATES & TIMES OF SESSIONS

The date & time of the first session & any subsequent sessions will be agreed via the bookly booking system at www.thegreenthread.club or via the Facebook or Instagram booking systems – these systems provide direct access & the availability in Kelly’s working calendar. Bookings can also be made via email with Kelly.

Sessions can only be rearranged in accordance with the section in these terms & conditions headed “Rearranging Sessions”.

PAYMENT TERMS

Fees can be paid online by debit or credit card using SquareSpace, via the Paypal payments systems or by bank transfer to The Green Thread Club Ltd, when bank details are specifically requested. Receipts will be sent via email.

Fees are payable in advance of each coaching session unless otherwise agreed. Where payment has not been received by Kelly in advance of a coaching session Kelly is not obliged to provide the session.

Where payment is required on receipt of invoice rather than in advance, a charge may be levied for late payment.

SESSIONS PREPERATION

Kelly will send the necessary session preperation form to clients, in advance of booked sessions. There is no obligation on the client to complete this form, but not doing so may reduce the quality of the service provided to the client by Kelly.

The client may contact Kelly by e-mail between sessions to seek clarification regarding anything arising from a coaching session or for administrative purposes (e.g. where a client needs to rearrange a coaching session or make a payment). Additional coaching can also be provided between sessions but there will be an additional charge for this. Kelly will always advise a client in advance if the nature of a client’s contact is likely to incur an additional charge & no such charges will be imposed without the client’s agreement.

REARRANGING SESSIONS

If a client needs to rearrange a coaching session, they should provide at least 48 hours notice. No refunds will be given to clients for unused coaching sessions unless 48 hours notice has been given. In exceptional circumstances Kelly may need to rearrange a coaching session. In those instances she will also give the client 48 hours notice where practical.

Where a client pays for a session or sessions in advance they must have the coaching session(s) that they have paid for within 6 months of the payment or their fee is forfeited.

CONFIDENTIALITY

Personal information or business information supplied by clients in coaching sessions will be treated as confidential. It will not be disclosed to a third party without the client’s prior permission, save where required by law or where action might be necessary to prevent harm to the client or someone else.

EARLY TERMINATION

In exceptional circumstances, such as illness or unavailability due to bereavement or other commitments, inappropriate behaviour by the client, actual or potential conflict of interest, or other reasons, Kelly can decide to terminate the service to the client early or refuse or be unable to provide further coaching sessions to the client. In such a circumstance the client will be given reasonable notice of termination by Kelly where practicable & the client will be refunded any advance payments made for coaching sessions not yet provided.

RESPONSIBILITIES

Kelly will seek to improve the client’s online business success & to achieve their desired outcomes. The client has sole responsibility for taking important decisions in their life or business. Kelly has no liability for any loss incurred by any client, whether financial or otherwise, following commencement of coaching sessions, or for any perceived failure by the client, whether justified or otherwise, to achieve a material improvement in quality of life or business or to achieve their desired outcomes or goals.

VARIATION OF TERMS & CONDITIONS

Where an Initial Number of Sessions is agreed, any changes to these terms & conditions intended to take effect prior to the conclusion of those Initial Number of Sessions will only have effect if agreed by both Kelly & the client & confirmed by Kelly in writing by email. In other cases, Kelly may change any of these terms or conditions including the Per Session Fee by giving the client one week’s notice in writing by letter or e-mail of the change(s). If following receipt of such notification of change, the client no longer wishes to proceed with further coaching sessions, they may withdraw from the service immediately by giving notice in writing by email or letter & they will then be entitled to a full refund of any fees paid in advance for coaching sessions not yet provided. Such notice will be effective on receipt by Kelly.

GOVERNING LAW

The Green Thread is registered in England & Wales under The Green Club Ltd (Company number: 11483353) registered at 27 Old Gloucester Street, London, WC1N 3AX, UK

This contract is governed by the law of England & Wales whose courts have exclusive jurisdiction in relation to any dispute, disagreement, proceedings or legal claim of any nature relating to the service provided or the contract.
